Rajkot woman Pooja Chauhan’s protest march in undergarments;cannot be punished

NEW DELHI: Rajkot woman Pooja Chauhan’s protest march in undergarments on Wednesday may have appeared indecent to some but legal experts feel there is nothing in Indian indecency laws that would find her on the wrong side of the law.

Experts say the Indecent Representation of Women Act will not be applicable in this case as Chauhan herself took to the street, probably as a last resort, after the authorities allegedly failed to listen to her grievances on numerous occasions.

The other laws that could haunt Chauhan are sections 292 and 293 of the Indian Penal Code, which deal with indecent exposure in public. But none of these will hold in Chauhan’s case, legal experts feel. Former attorney general, Soli J Sorabjee, lauding the 22-year-old’s courage in forcing the authorities to register her complaint, said, “There is nothing indecent about undergarment protest, which is a novel mode of exercising freedom of expression.”

According to Supreme Court guidelines, the test of obscenity is “whether the tendency of the matter charged as obscenity is to deprave and corrupt those whose minds are open to such immoral influence, and in whose hands a publication in media of this sort may fall.”

Advocate Aparna Bhat agrees with Sorabjee and says it is clear from the apex court’s guidelines that Chauhan would not be liable to be proceeded against under the indecency laws.

“Anyone who saw the pictures or video footage would first think that the grievances must have been overwhelming to have forced a woman to undertake such a protest march in public,” she said.

People who still think she is on the wrong side of the law should first proceed against film producers and heroines who are even more scantily dressed than Chauhan in movies, she added.

Advocate Vibha Makhija said one should look at the circumstances that drove Chauhan to stage the protest. “The indecency law hinges on the intent of the exhibitionist. I do not think she has flouted any law. There was no intention on her part to arouse carnal desire among others. She was in distress and took this extreme step to register her protest,” she said.

    Indeed, under this blackmail, the woman’s husband and in-laws have been summarily arrested and are being subjected to “justice” a la the Indian media’s “Kangaroo Court”.

    And, as if this is not enough, governments are tripping all over themselves to “punish” police officers who had failed to act on Pooja Chauhan’s original complaints (and presumably also reward those police officers who, stampeded by these idiots, rubbish the law in order to wrong her husband, inlaws and neighbors).

    Moreover, pompous imbeciles eagerly assure us, the great brainless public, that “no woman would morally degrade herself unless pushed to extremes”.

    Therefore, women, cross our hearts, are incapable of moral wrongs unless really pushed hard.

    Of course, the corrollary is that men have no moral compunctions worth speaking of, and will degrade themselves at the drop of the hat.

    And the rights to justice and against being prejudged (whence the legal term “prejudice”, that VIRTUE so wellbeloved of the Indian state and the pompous imbeciles that run the Indian state and media) of Pooja Chauhan’s husband, in-laws, and now, of course, all those of her neighbors, etc., against whom she may bear whatever kind of a grudge, go out into the dustbin.

    All this adds up to tell us that Justice in the India that Mohandas Karamchand Gandhi fought so hard to fashion, is not so much a jackass as much as it is a Prostitute – a Tawaif.

    God help us and rescue us from the dainty delights of Indian Justice.

    1) Why she did not go to court and file a case? Even if police are inactive one can appraoch the courts …..

    Ans : She wants to harass her in-laws as she wants them to be arrested without providing any evidence.

    2) Why she did not file a case under PWDVA (protection of women under domestic violence act)? there are 100s of case ALL OVER INDIA

    RAJKOT: A woman tried to immolate herself at the Local Crime Branch (LCB) premises, police said.
    Hansha alias Puja Parmar was prevented from torching herself by officials present there.
    According to her complaint, she was being harassed by her husband and in-laws for dowry for which she sought police help.
    After police failed to help her Hansha decided to end her life.
    She had also tried to commit suicide by consuming poisonous substance couple of years back.
    Her husband and in-laws have been booked for harassing her for dowry, police added.

    She claims she is mad – if so how can the authorities, as per the writen law, entertain any complaint from an insane/mentally disturbed person.

    If she is not mad….. why did not the police first take up the case of public nudity against her, since that preceded anything!.

    Rajkot, July 07: Pooja Chauhan’s husband Pratap Chauhan has alleged
    that his wife is an alcoholic and indulged in flesh trade.

    Pratap has also alleged that Pooja was married before marrying him.

    In a written statement released to the media, Pratap, a labourer from
    Shantinagar slums on the 150-feet ring road, said that one Pratima
    Deepak, who resides near Amrapali Cinema, is Pooja’s agent. “Together
    they have been running the illegal activity of prostitution,” he
    said in the statement.

    Pratap, who has been summoned by the First Class Judicial Magistrate
    on July 10 in connection with a case filed by Pooja alleging him of
    mental and physical harassment, said that it was in fact Pooja who
    had been cheating and harassing his family since their marriage in
    2004.

    According to him, they got married on April 3, 2004. At the time of
    the marriage, she declared that she was an orphan. “But later I
    discovered that her parents were alive and she was already married to
    one Bhupat Gohil before marrying me,” he said in the statement.

    Pratap further said that he found her to be an alcoholic who would
    often physically and mentally harass his mother Hansaba. A month
    back, he had registered a complaint against Pooja in this regard at
    Gandhigram Police Station.

    What atrocious comments from the so called literate and cultured men of India…Even if she is a prostitute as you all seem to have great joy in calling her, Pooja still has the basic right to record a complaint if she was harassed. The duty of the police is to register and then act accordingly. If she has chosen to protest in this unique way, it is only to get the attention that she has been pleading for in normal ways and not getting.

    She didnt look a bit more indecent than all those page 3 celebrities dressed for a late night party or those film actresses “acting” out a role…I did think she was more covered…you only have switch your channel and see a less covered female whom the entire family watches together…

    Shame on you India…you cant treat your women better, cant you?

    Pooja has already proven to be a fraud. The cases she filed are fraudulent. She should be prosecuted under section 182 for filing false cases. As to the truth about her mental faculties, it would be revealed in the trial. We should not let such fraudsters to go scott free to cause havoc elsewhere.

    The main area where is pooja should be charged with is the attempt to sucide . furthur more it looks like that this attempt was more of an intimidation attempt rather then being really harassed or anythings.

    Though you don’t deserve a lesson from me, I am still writing it for my fellow Indians, those who still want to see a happy Indian family.

    I am sure you would have gone to school and you would have passed exams ( I am NOT saying that you would have LEARNT anything there)

    so there used to be a subject called science, and science has proven that a CAT can selectively block a certain frequency of sound and can selectively concentrate on a certain frequency of sound. CAT does this so that she can sleep even if people around are screaming. so CAT blocks frequency of other folks around, but CAT does not block the frequency of it’s prey, so if any of its prey is making a noice at certain distance, then even if CAT is sleeping, it will wake up and go in that direction.

And all of a sudden, you tell yourself, “How dare she/he have an opinion different from mine?!?” and post a ridiculous analogy about the behaviour of cats!!

    So, lets review shall we? Bravo_pooja saw the comments she/he didn’t agree with, saw one that she/he did agree with and decided to voice her/his support.     By the way, I really sympathize with the men who are suffering at the hands of their wives.     RAJKOT: In what is being seen as a damage control measure by the police, an application against Pooja Chauhan, filed with the police on April 12, 2006, by her husband, surfaced on Saturday.

    Pooja has become a source of major embarrassment for the police after she marched semi-nude on the city streets on Tuesday to highlight the force’s inaction on her complaint against her husband and in-laws.

    The ‘freely’ distributed application by her husband, Pratapsinh, however, had not evoked any interest then among the cops concerned, who had recorded his statement and then forgotten about it. It is the content of these applications, which have raised doubts among many here about the twist being given to the Pooja case.

    In his application Pratapsinh had levelled several allegations against Pooja, accusing her of being a characterless woman and being married to someone else even as she got married to him. Pratapsinh, while alleging that she was not taking proper care of their child, had sought action against her.

    On November 16, 2006, Pratapsinh submitted another application following which police had registered a case under section 107 of CrPC against Pooja, who had tried to commit suicide on February 16, 2006.

    Ironically, despite the number of accusations levelled against Pooja, including that of being a habitual drinker, gambler and of engaging in flesh trade, her husband later struck a compromise and chose to stay with her.

    To Mr/Ms A , Bravo_Pooja, CATS,….Z…

    As per my limited understanding, In order to run a house hold successfully and smoothly there are many things that are required, I am trying to list a few here.

    1. Food : Someone needs to make ( cook food, most of the indians eat at home most of the times ), Money to buy that food.
    2. House : Owned or Rented ( both of these options require money )
    3. Medical Expenses : Once in a while people need to spend money on medical care.

    4. Bills to pay : humans use tons of services like electricity, water and tons of other stuff.

    So we can categorize the things in two major categories :

    1. Money
    2. Manual Work.

    In order to complete any project a team needs to divide the tasks so that the team can finish the project efficiently.

    So lets consider if Man of the house takes the responsibility of “Money” part so that the household has money to pay for all the services the house hold is using, also money to buy food. so of course the responsibility of other work like “cooking, washing, ironing… etc” falls on the “woman of the house”.

    ( In case someone tries to poke his nose saying that “even woman work now a days”, I would say what about the case where woman does not work and has tons of servants around in the house to take care of cooking, washing and all….In this case why the hell man should go out and make money? and woman just stay at home and watch “Kyunki Saas bhi kabhi bahut thi”, so in short we are talking about majority of cases and not about the exceptions )

    So now lets consider the text posted above :

    Now lets see when a woman who is not working to earn the money for household, and her husband is going out to make money for the household. When he comes back from work, cant he expect food at home? man is already taking care of the responsibility he took, what about woman? when she does not fulfill her part of responsibility? what should a man do? “uska Mandir bana kar pooja karega kya?”, being a human being of course he will be upset, the way woman get upset when her friend has a better neckless than her…

    I can respond at length to each and every sentence and word you have mentioned in your comment at length, and of course I can use LOGIC in that, and no one can point to it that what I have mentioned in wrong, but I would rather spend my energy in supporting our fight against biased laws like 498A, DV and all.

    If you are guy, and someday you are falsely implicated in 498A , DV or any other biased laws in India, you are welcome to join our groups, we will forgive you for your current thoughts against our group.

    If you are a woman, and currently enjoying these biased laws, we would NOT wish you also get into 498A DV through your sis-in-law, daughter-in-law, or even better as neighbor of someone who has filed a 498a or DV. but in case god forbidden something like this happens to you, you will be welcome to our fight against the system.

    I can talk for hours, can provide tons of material, but I have a firm belief in following.

    1. Dont argue with a fool, because a fool will bring you to his level and beat you with the experience.
    2. Dont argue with a fool, because a on lookers can not differentiate.

    Punish Pooja Chauhan? Hasn’t she suffered enough? Many of you seem far too concerned with the concept of honour, and less concerned about the quality of life of ALL Indian citizens (even women!). Do you even understand the misery she must have suffered to push her to a point where she walked through the streets in her underwear? Do you have no compassion? There is absolutely no excuse for using physical violence in this situation, whether she refused to cook the dinner or not. If you cannot see this then it is YOU who are the fool, and a heartless one at that.

    I believe that many of you are too afraid to look inward and take steps to prevent situations like this occurring again. Instead, you will blame women like Pooja, which is easier than perhaps examining and changing your own behaviour. After all, a women’s physical and mental health counts for next to nothing when it comes to getting the dinner on the table when he gets home.

    poor indian family, so breaking up because of “bad” indian women seeking to “harrass good husband and in-laws”
    ask me.
    10 years of a violent marriage. harassed for dowry – “ma baap toh apni betiyon ko pait kaat ke dete hain”. so much violence that my son had to be put into a center for children with learning disabilities because he had seen so much violence. a husband with all the moral order of a tom cat.
    i left 5 years ago with my children – there were no charges that were not levied against me, no allegations that were not made.
    today i am divorced – a single mother raising my children – thankful to be alive – and finally at peace. my son is in the process of being mainstreamed, my daughter is doing better than ever. and i released a book called “woman of the elements” on the 8th of november, 2006. it is about discovering yourself and the joy and power within you as a woman. something i never knew while i was married and living in hell.
    i don’t know whether pooja was right or wrong in the way she went about getting the attention that she so desperately needed.
    but who has the right to judge her?
    i know what it is to live in hell and hopelessness – and i know that no one on earth has the right to take you to this point of desperation.
    marriage is a wonderful institution – but only till such time that both people in the marriage cherish and allow the growth of each other.
    no one has the right to sit on judgement on her – no one at all – for no one can know all she would have gone through to come to this desperate point.

There are MANY men (and women in their families) in this country who suffer today, because they married someone for love, while their wives had other selfish notions of marriage. These people live through hell, torn apart by bit by bit.

    Great to hear your story and sorry about the mental and physical torture you and your child had to go through. Usually after a decade of abusive relationship, people just give up and accept the abuse as their destiny. Everybody wants a family, a beautiful relationship and a peaceful life, but if the relationship is abusive and the other person is not open to communication then there is no point living an undignified depressed life. Life has much more meaning than saving the so called culture at the cost of a victimized spouse.
    Live your life fully and good luck for your book.

    It is not the first time that We indian have seen this. It keeps happening, bcos this case was covered by media, its become popular.

    could see that we Indians have plenty of time exchanging idieas on a silly act of Prostitute Pooja.

    It is not the first time that We indian have seen this. It keeps happening, bcos this case was covered by media, its become popular.

    Prostitues like pooja can stoop down to any extend, its only the men who sufferes every time.

    I don’t figure out why she did not went naked? Why were undergarments still part of her body when she protested? She should have been brave enough to remove those also. This is a conspiracy to destroy husband and family. But anyhow women are doing better to control population. A warning to the boys! Either rise above the level of sex or face such situation where the husband and in-laws of pooja are now in. You should be the responsible citizen to control rising population. Ban marriage with full force. This is an ugly institution.

    i dont think it is anything to praise her about …i’ve never heard of this form of protest, she did this just to grab attention of media and to harass her in laws …& y does she have to involve her neighbours in, she is too clever for a common person to be fathomed, weilding a slugger like a hooligan, running around semi nude ….she is one revengeful bitch whom no one would like to marry ..have some sympathy for the poor husband …& how many men who are all praise for her like to have such a woman by their side, and how many women would like to protest like this themselves or have such a female as their mother-in-law or sister-in-law or any other relation …
    so my dear hypocrites step into reality & stop praising her as this will only increase such stupid incidents….

    Some of you here are unfair in calling this woman a prostitute. The fact that she was corageous enough to fight back should put her on a pedestal and not down the toilet as some of you have done. If she had, instead, stuck a knife into some of those people in anger then we would all call her a murderess. As is it, she prostested. Whatis wrong with that ? She did not offend anybody.
