NEW DELHI: In an unprecedented incident, the wife and son of a sitting high court judge were accused by his daughter-in-law of throwing her out of UP Bhavan in Delhi in the dead of night and snatching away her child.
Narrating her pitiable condition, counsel Kamini Jaiswal pleaded with a Bench comprising Chief Justice K G Balakrishnan and Justice R V Raveendran for immediate restoration of the child to the mother, Samina Khan.
The court lost no time in gauging the gravity of the situation, which was potentially damaging to the judiciary, and directed the wife and son of the sitting judge, Jaya Quddusi and Rahat Quddusi, to produce the three month-old Moit before the additional district and sessions judge at 2 pm on Saturday for handing over his custody to the mother.
The Bench, apart from issuing the interim direction for restoration of the infant to the mother, also issued notices to the wife and son of the sitting judge.
Samina alleged that her harassment at the hands of the in-laws family started ever since her marriage to Rahat on March 21, 2004 according to Muslim rites at Lucknow. “The mother-in-law started raising illegal demands of dowry and caused mental torture and harassment,” she alleged.
“The petitioner was physically beaten for not meeting the illegal dowry demands and she was admitted to hospital for treatment on a number of occasions. She is still being tortured both physically and mentally,” Samina alleged.
She was constantly confined to the house and this led to her mother filing a habeas corpus petition before the Lucknow Bench of the Allahabad High Court. A single-Judge Bench refused to pass any orders after Samina was produced before him in chamber. Later, the matter came to be compromised.
On January 7, 2007, Moit was born and on March 21, the father-in-law, who is a sitting judge of the Cuttack High Court in Orissa, gave a grand party to celebrate the birth of the male child, Samina said.
On May 4, Samina came to Delhi with her son, husband Rahat and mother-in-law Jaya to attend a marriage ceremony and stayed at UP Bhawan, Sardar Patel Marg.
“At 2 am on May 4, Rahat and Jaya brutally assaulted her and threatened to kill her for no fault of hers. She was thrown out of the UP Bhawan and the three-month old baby was forcibly taken away by Rahat and Jaya,” the petition alleged.
She and her Noida-based father called police and went to Chankaypuri police station, but they refused to register an FIR. “Till now she is unaware of the whereabouts of her 3-month-old breast-feeding child,” Samina said.
On the allegations about the police inaction, the court also issued notice to the Delhi government, the commissioner of Delhi Police, DCP (south) and SHO of Chankaypuri police station.

as for the comment some Mr. Binoe has commented on my case that why the case reached supreme court in 16 days ,its because 3 month old child cannot live without mother.so i had to take the help from the media.why the daughter in law of judge was not thrown out in orisa beacuse there he is posted ,it would affect his position, no one is fool to do that blunder.his son was already a divorcee ,he had the history of such tortures to the first wife. if you are not aware of the truth than dont comment to hide it ,ohther wise supreme court would have reacted on such issue if they found it meaningless.

Let me tell you, just because you are a lady the Court lower or higher or even the Supreme Court falls for your Gender!!
I do not trust that story of yours!! If you are litrate enough and had known his previous torture history you would not have married him unless you wanted to make good his history for your own family’s vested financial interests!!!
Just a small question even after knowing his previous history how did your family agree to sell your Body and womb to him?? – the fees for which you are demanding!! – So does it not prove that your own family was making a Prostitute of you??? Sell you then you sell your womb and then get to the media and seek assistance for your service charges and your womb’s rent??….your so called “some Mr. Binoe”
